Welcome to SankofaJourney.com (“Company,” “we,” “us,” or “our”). By accessing or using our website and services, including booking or participating in any journey, you (“User,” “you,” or “your”) acknowledge that you have read, understood, and agreed to comply with these Terms and Conditions (“Terms”).
By accepting these Terms, you do so on behalf of yourself, your heirs, assigns, executors, administrators, successors, family members, relatives, and any other individuals who may have a legal interest in or derive benefits from the journey.
If you do not agree with any part of these Terms, you must refrain from using our website, accessing resources, participating in services, or contacting any staff or affiliated parties related to SankofaJourney.com. Unauthorized use of the website or services without agreeing to these Terms constitutes a violation of the Terms.
2. Services Provided
SankofaJourney.com offers curated travel experiences, including tours, accommodations, cultural immersion activities, and other related services (collectively, “Services”). All services are subject to availability and may change without prior notice.
3. Booking, Payment, and Refund Policy
a. Deposits and Payments:
- A non-refundable deposit is required at the time of booking to secure your reservation.
- Full payment must be completed by the specified due date prior to departure. Failure to pay the balance by the deadline may result in the cancellation of your booking without a refund.
b. Refund Policy:
- Non-Refundable Deposits: All deposits are strictly non-refundable.
- Partial Refunds: If a written cancellation request is made at least 90 days (3 months) prior to the departure date, you may be eligible for a partial refund, excluding the non-refundable deposit and any other non-recoverable costs.
- No Refunds: No refunds will be given for cancellations made within 60 days of departure or after flights have been purchased on your behalf.
- Unused Services: No refunds will be provided for any unused portion of the journey, including accommodations, meals, or other services not utilized.
c. Transfer and Deferral Policy:
- Transferable Journeys: Bookings are transferable within 60 days of departure to another person, provided that the substitute participant is approved by the curators and meets all eligibility requirements for the journey. You are responsible for any fees related to flight changes.
- Deferred Journeys: You may defer your booking to a future journey within two (2) calendar years, subject to availability. The deferred participant must be approved by the curators and must also meet the qualification requirements for the journey.
4. Travel Insurance
We strongly recommend that you purchase comprehensive travel insurance to cover trip cancellations, medical emergencies, accidents, lost or stolen belongings, and other unforeseen events. You are solely responsible for obtaining and maintaining adequate insurance coverage.
5. Vaccinations, Visas, and Travel Documents
a. Medical Advice and Vaccinations:
Fellow travelers and curators may provide information or share personal experiences regarding vaccines and travel health precautions. However, they are not medical experts, and this information should not be construed as professional medical advice. You should consult your healthcare provider for personalized medical advice regarding vaccinations and travel health.
b. Visa and Government Paperwork:
You are responsible for obtaining and maintaining all required travel documents, including passports, visas, and any other necessary permits or authorizations.
- Disclaimer: The curators are not responsible for guiding, managing, or completing any government paperwork or visa applications.
- Accuracy of Information: It is your responsibility to ensure the accuracy and completeness of all submitted documentation.
6. Assumption of Risk
You acknowledge and accept that travel involves inherent risks, including but not limited to personal injury, property damage, illness, accidents, or death. You voluntarily assume all such risks and agree that SankofaJourney.com shall not be held liable for any injury, loss, or damage to you or your personal belongings arising from participation in any of our journeys or related activities.
7. Limitation of Liability
a. Third-Party Services:
SankofaJourney.com acts solely as an intermediary between you and third-party service providers (including but not limited to airlines, hotels, tour operators, and transportation providers). We are not responsible or liable for the acts, omissions, errors, or failures of these third parties.
b. Force Majeure (Acts of God):
We shall not be liable for any loss, damage, injury, or delay resulting from natural disasters, pandemics, weather conditions, civil disturbances, acts of terrorism, government actions, or any other circumstances beyond our reasonable control.
c. No Guarantee:
We make no guarantees regarding the availability, quality, safety, or accuracy of any services provided by third parties.
8. Indemnification and Hold Harmless Agreement
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless SankofaJourney.com, its curators, assigns, affiliates, officers, directors, employees, agents, and representatives from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:
- Your use or misuse of our services.
- Your violation of these Terms or any applicable laws.
- Any injury, loss, damage, or harm (including death) sustained by you or your personal belongings while participating in the journey.
- Any act or omission by third-party service providers contracted by SankofaJourney.com, including but not limited to airlines, hotels, venues, or local operators.
- Cancellations or interruptions caused by events beyond our control, including airline cancellations, natural disasters, acts of God, or shortcomings of contracted business operators.
You expressly waive any claims against SankofaJourney.com arising from any such incidents and agree that this indemnification and hold harmless provision shall survive the termination of these Terms.
9. Arbitration Agreement
Any disputes, claims, or controversies arising out of or relating to these Terms or the use of our services shall be resolved exclusively through binding arbitration under the rules of the American Arbitration Association (AAA). The arbitration shall take place in Raleigh, North Carolina, and shall be conducted in English.
- You waive any right to bring claims as a plaintiff or class member in any purported class or representative proceeding.
- The arbitrator’s decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
